Drawbacks at Preliminary Investigation

On March 10 of 2011, the trial over closing the criminal case of Derenik Gasparyan, who died at school as result of a fight, was tried at Hrazdan office of RA Kotayk District Court of First Instance.

The victim’s successor D. Mkrtchyan, his representative A. Zalyan, senior prosecutor A. Vardanyan from Kotayk region Prosecutor’s Office and interrogator H. Mkrtchyan from Charentsavan Investigation department participated in the trial.

During the court trial, the victim’s representative A. Zalyan presented 12 deficiencies that weren’t identified during the preliminary investigation. Particularly, the following points failed to be identified during the preliminary investigation:

•    The time and the location of D. Gasparyan’s class supervisor during her absence
•    The exact time of the fight, the time of the school maintenance personnel arrival, and the interval between the fight and hospitalization.
•    The existence of a medical center at school and the location of the relevant staff
•    Would it be possible to save his life in case first aid was provided immediately. 

Pointing out the violations, A. Zalyan also added that the preliminary investgation and expert’s conclusion failed to reveal the the following issues:

     1. What could have caused the changes in D. Gasparyan’s internal organs?
     2. When exactly did the death occur after the changes in internal organs?
      3. How long did D. Gasparyan stay alive after the changes in his internal organs before the death?
       4. What interventions could have saved his life?
       5. Did the boy suffer from any type of a disease when he was alive? Were there further developments of the disease and could they have caused death?

In response to the posed questions, the prosecutor conducting monitoring over the case and the inerrogator implementing preliminary investigation noted that the investigation was carried out appropriately, the complaints presented by the representative have been considered, and the noted claims were totally groundless.

After the trial the judge left for the advisory room to conclude the resolution. The vedict will be promulgated on March 18 of 2011 at 14:00 p.m.
