Vanadzor Municipality Responded
Human Rights Protection Rights of the Elderly Local Democracy

On January 25, 2011, Vanadzor Municipality sent a reply to the Vanadzor office of the RA Administrative Court to defend the legality of property donated by the Vanadzor Community Avagani Resolution.It should be noted that on December 13, 2010, HCA-Vanadzor submitted a claim to the Vanadzor Office of the RA Administrative Court with a demand to repeal or abrogate #75 Resolution taken on October 26, 2010. Pursuant to the resolution, Vanadzor football stadium, in conjunction with 44.000 square kilometers located in Taron 4 District was donated to the RA Football Federation. The organization appealed the resolution justifying that the Avagani is not entitled to donate community property. It can be liquidated by sales. Therefore, the resolution regarding the donation cannot be considered legal. In response to the decision, the Vanadzor Municipality justified the legality of the donation resolution. It is particularly noted in the response that the area in question is the property of the community by a legal ownership certificate and makes reference to the relevant provision of the Civil Code which endorses that “The owner, by his own consent, has the right to carry out any activity regarding his property that abides by the law and doesn’t conflict with another person’s rights and interests stipulated by law including transferring ownership to another person, passing them the rights to use, possess and command the property by sale or other means”. In this regard, the organization became aware that the October 26, 2010 Resolution, submitted by the Vanadzor Community Avagani, violated the property ownership rights of the Vanadzor community residents. They were illegally deprived of their community stadium and that is why they applied to the Court. Now the court will decide if the Avagani resolution was legitimate.
