Helsinki Citizens` Assembly Vanadzor Office Claims an Abrogation

On October 26, 2010 the subsequent court session, presided by judge A. Alaverdyan, was held at the Vanadzor office of RA Administrative Court, where the case claimed by Helsinki Citizens` Assembly-Vanadzor regarding the abrogation of the illegal administrative act of Stepanavan avagani, was examined.

It should be noted that HCA Vanadzor claimed to annul the Stepanavan avagani resolution, based on which the municipality had defined a - 500 AMD charge for the photocopy of each page of the resolution. During the court session, the judge presented the written proofs provided by the plaintiff and respondent party and asked them to justify them.

The organization representative A. Zalyan justified the case claim, according to which, the Stepanavan avagani had violated part 3 of Article 52 of RA criminal code, part 3 of Article 10 of RA law on freedom of information, 18 part of Article 16 on Local Self-goverment Authorities, as well as part1 and 2 of Article 20 of  RA law on legal acts.

Stepanavan municipality representative H. Mkhitaryan , who was  presenting the interests of the respondent party, failed to justify the legality of  # 19 decision made by the Stepanavan community. The latter presented a written the objection to the court against the claim submitted by the organization. In response, the judge explained to the respondent party that the objection did not relate to the claim subject. 

HCA Vanadzor representative A. Zalyan noted that he was not familiar with the objection brought up by Stepanavan municipality, because it had not been provided to the organization prior to that.

It should be noted that the mentioned document was not promulgated by the judge as well. 

After hearing the 2 parties, the judge left for advisory room to conclude the resolution.


The verdict will be pronounced on November 9, 2010, at 17:45
