Subsequent Donation from Vanadzor Community Budget

On October 26, 2010, a resolution on another property donation was made during Vanadzor Avagani session. 9 Avagani members voted for, 3 against the resolution and 3 abstained from it. According to the resolution, Vanadzor football stadium along with an area of 44.000 square kilometers located in Taron 4 district were donated to RA Football Federation. As a justification for the decision, Vanadzor mayor (community leader) and Avagani brought the fact that RA Football Federation made financial contribution for the renovation, reconstruction of the stadium as well as the construction of football stadiums in Taron 4 district. The Avagani members and Vanadzor mayor did not consider that RA Football Federation makes the contribution from UEFA funding. The financial means, according to UEFA principles, have been allocated not for individual or group benefit, but for developing football in the community. Whereas, in this particular case, the privatization is carried out from Football Federation, which has other problems to address. Actually, the fact that the stadium and the community territory was donated to the Football Federation with ownership right also contradicts UEFA principles. This time again, the Avagani takes a decision by which the community property donation deprives the community budget of additional funds and guarantees for sports development within the community. It is worth noting that on June 25, 2009 HCA Vanadzor submitted a claim to Vanadzor office of RA Administrative Court against Vanadzor municipality and Vanadzor community Avagani with a demand to annul # 29 resolution ( a resolution on donating property to provided to Electric Network of RA, Debed branch) made on April 23, 2009 by Vanadzor Avagani. The Administrative Court rejected acception of the complaint, justifying that, according to RA Administrative Procedure Code, the organization did not have the right to appeal the decisions related to public interests. HCA Vanadzor disputed in RA Constitutional Court if this article of RA Administrative Procedure Code is constitutional. The Constitutional Court found in its decision that NGOs should have the right to protect public interests in the court. Taking this opportunity HCA Vanadzor is going to initiate a court process to abrogate this resolution by court.
