Legal consultation in the towns of Alaverdi, Tashir, Stepanavan, Spitak of Lori region

In January, 2010 five citizens applied to HCA Alaverdi, Tashir, Stepanavan, Spitak  offices for legal consultation. A letter was prepared to solve one citizen’s problem.

The citizens applied to the organization for the following problems:

Stepanavan district

The right to a fair trial

1. The crime caused health damage. The citizen went to hospital and spent some money for recovery. What document can prove and how can the compensation for health damage be received from the person committing the crime?

 The citizen can claim compensation for health damage through court for which he needs to submit relevant documents.

 Alaverdi district

2. The citizen had an accident in his own car. The other party applied to the court demanding compensation to which the citizen does not agree. 

The citizen was told that within 2 weeks after getting the claim he had a right to submit a counterclaim in case of disagreement with it. The materials of the case have been studied and the citizen was advised to submit a claim response. 

Social right

3. The citizen has a 2nd group of disability, has 16 years of work experience and gets pension in the amount of AMD 12.204 per month.

The benchmark assessing the level of families’ insecurity changed though the citizen lives in the same living conditions as before. Can the citizen get family benefit? 

A letter was prepared addressed to RA Ministry of Labor and Social Affairs to clarify the grounds for terminating the payment and the possibility for its restoration. 

4. The citizen was dismissed from his position as he reached his retirement age but he worked for 2 more months. The last 2 months wasn’t counted as work experience. How can the 2 month’s work be proved as work experience? 

It is necessary to take a relevant certificate from the employer showing that the social security payment was paid and submitted to the pension fund. In case the employer refuses to provide the certificate the citizen can apply to the court. 

Right to Property

Can a person be returned the money from the former Soviet Union saving banks by the right of succession? 

According to the procedure of paying the deposits made in the former Soviet Union saving banks before June 10, 1993, the person cannot pass his/her right to another person. Therefore, the right have the right to either use the certificate of the deposit.
