The Classification of the Citizens’ Problems According to Rights* Social Issues – 2 persons applied on the order of getting family benefit. They wanted to know how they can apply to social structures to get family benefit. They have been explained the legal ways of applying to social structures and were told what documents they would need. 1 person was given consultation to submit written applications and necessary documents to social structures for calculating the scores. 1 person was deprived of family benefit because he did not have a social card. He has been explained that the Constitutional court made a resolution on recognizing some provisions of the law “On Social Security Cards” anti-constitutional. These are the provisions that obliged citizens to get cards. 1 person applied to HCA Vanadzor on getting reimbursement for his deposit in the bank. * The Right to Heritage and Will – 2 persons applied to HCA Vanadzor in connection with the right to heritage. Their issue concerned the order of admitting and registering heritage. They were presented with the norms regulating legal relations defined by RA Civil Code and the practice of its implementation. They have been told to sign contracts in the notary office, ratify and then apply to Vanadzor regional real property cadastre adjacent to RA Government. 1 person inherited real property but real property cadastre adjacent to RA Government does not register the rights. The citizen was told to dispute the actions of the cadastre in the court. * The Right to Housing -- 10 citizens applied on housing problems, particularly on getting a new flat and getting the right to make use of another person’s house. The citizens had been explained that the right to make use of the territory of a house had to be registered in the state structure of real property; otherwise it wouldn’t be protected in the court or other bodies. By the decision of the court 1 citizen got the right to use a house. At present the owner of the house hinders him to live in that place though he has been informed that the owners did not have the right to create obstacles in that case. 1 person bought a house but in stead of making a sale and purchase agreement, the seller gave a receipt proving that he had received the sum for the house. Now the person who sold the flat does not want to make a sale and purchase agreement. The citizen was told to apply to court based on the second part of article 300 of the Civil Code. HCA Vanadzor supported one citizen to submit a written application to the municipality of Vanadzor. After receiving the answer the citizen was informed that his case was in the court according to the information received from the municipality. 1 person was supported to apply to the municipality of Vanadzor on prolongation of his tenure. * The right to fair trial – 1 person got information on the terms of calling to criminal responsibility for robbery. He was presented the duration and the order defined by the article 117 of RA Criminal Code. 2 persons applied on discussing a court resolution. The court had upheld the claim of “Lori-Jrmughkoyughi”/water sanitation service and decided to exact the sum from the citizens. The court made the decision without the citizens’ presence though they had been informed. /According to article 6 of the European Convention on Human Rights/ * The right to ownership -- 2 persons occupied territories on their own accord. They want to get a right to ownership. They were presented the demands of the resolution of Government #912, according to which the citizens should apply to the municipality of Vanadzor in order to get rights for the occupied territory. An action has been brought against one citizen with the aim of removing from a temporary dwelling. The person has nowhere to live in. He has been advised to submit a counterclaim demanding to invalidate the auction. 1 applicant is a co-owner of a house, who wanted to know his rights as the other owner, his father, wants to sell the house. He has been explained that no one can sell the house without his agreement and he has the right to own, use his property (according to article 1 of the European Convention on Defending Human Rights and Fundamentals Freedoms). 1 person bought a house. The former owners of the house are still registered there. He was given advice to apply to the passport department of the police requesting to quit the former owners’ registration. * The Right to Labour – 2 persons applied to HCA Vanadzor on the issue of salary. 1 citizen wondered on what grounds the size of his pension had been calculated. He got support in preparing an application to address to the State Fund of Social Security. * Consumers’ rights – 2 persons complained about “Jrmughkoyughi” /water sanitation service/ CJSC, which illegally demanded debts from the. The demanded sum is more than intended. They were told to address to “Lori-Jrmughkoyughi” to ask for calculations, and if the results are not satisfactory told them to apply to court. 1 person All the citizens have been provided with oral juridical consultation. HCA Vanadzor supported four people to prepare documents for submitting relevant structures.
