The Problem of Sold Territories is Still Actual

On January 16, HCA Vanadzor organized a press conference on the sale of temporary dwelling areas of Vanadzor.The press conference aimed at publicizing the sale of the temporary dwelling areas. The coordinator of HCA Vanadzor, Arthur Sakunts, presented the results of the research done on the process of selling the land where the temporary dwellings are. In 2002-2004, 41 pieces of land were sold by auction by the municipality of Vanadzor. Now those areas have new owners but the temporary dwellings are still there. A. Sakunts stated that the municipality kept the fact of sale in secret. The inhabitants were not aware of it. At the same time, the municipality is acting as the owner of the land. It demands that the inhabitants of those temporary dwellings should vacate the territories. Who are the owners and why does the municipality of Vanadzor apply to the court of first instance of Lori region instead of the owner. In July 2006, HCA Vanadzor sent a letter to the Prosecutor’s office in order to find out the legality of the sale. The answer was received in December. In the letter it was mentioned that the municipality of Vanadzor had sold the 1st, 2nd, 3rd, 4th and 5th temporary dwelling areas. They are near the chemical factory of Vanadzor. The sale was done in auction according to RA legislation. The residents of the temporary dwellings did not know about the auction, therefore they did not participate in it. In this case, as the prosecutor’s office mentions, the residents can appeal the demand of the municipality in court. “By this press conference we want to inform our beneficiaries that the demand of the municipality is illegal”-A. Sakunts said. He also informed that a similar claim of the municipality was appealed in the court of Appeal and the court dismissed the claim of the municipality. At the end Karen Tumanyan, the coordinator of the juridical department of HCA Vanadzor, presented the legal consequences.
